Terms & Conditions

These Terms & Conditions govern the products, projects, and services provided by Building Alternatives and Innovations Corp., operating as BALAI Philippines and BALAI Cabins. By signing a quotation, proposal, contract, work order, or other written confirmation, or by making payment for any BALAI product or service, you agree to be bound by these terms.

a) Product representation

Images, plans, renderings, samples, and website materials are provided for reference and planning purposes. Actual colors, textures, finishes, materials, and details may vary due to lighting, screen settings, supplier batches, site conditions, and natural material variation.

b) Plans and measurements

Clients are responsible for reviewing all official plans, dimensions, materials, finishes, and confirmations before approval. If any detail is unclear, clients should request clarification from the BALAI team before signing or paying.

c) Customization

BALAI cabins and related works are often custom-made for a specific client, site, and project brief. Once design approval, procurement, fabrication, or production has begun, customized work cannot be cancelled, returned, or refunded except as required by law or agreed in writing by BALAI.

d) Materials and tolerance

Minor or immaterial variations in dimensions, alignment, color, texture, shade, grain, pattern, material batch, or finish shall not be considered defects and shall not entitle the client to reject the work or claim compensation.

A binding agreement is formed when the client signs a contract, approved quotation, proposal, or other written confirmation issued by BALAI, or when BALAI accepts payment for the project.

Requests for revisions, additions, upgrades, substitutions, or other changes must be submitted in writing. BALAI may issue a revised quotation, schedule, or change order when the request affects cost, materials, manpower, logistics, engineering, or completion timelines.

The price payable by the client is the amount stated in BALAI's official quotation, invoice, contract, or written confirmation. Unless otherwise stated, quoted prices are inclusive of applicable VAT.

Additional charges may apply for delivery outside covered areas, island or inter-province logistics, difficult access, special equipment, site-specific requirements, client-requested changes, additional works, storage, or remobilization.

Payment shall follow the schedule and terms stated in the approved quotation, invoice, contract, or written agreement. Production, procurement, scheduling, mobilization, delivery, or installation may begin only after BALAI receives the required payment.

BALAI may suspend work, adjust schedules, withhold delivery, or pause turnover if payments are delayed or incomplete.

BALAI reserves the right to decline, suspend, or cancel an order when required materials, manpower, logistics, technical resources, or delivery coverage are unavailable; when client requirements fall below BALAI's safety, design, engineering, quality, or compliance standards; or when a pricing, typographical, technical, or clerical error has occurred.

BALAI may provide a Gantt chart, work schedule, target timeline, or delivery estimate as a project guide. Unless stated otherwise, timelines are counted in working days and begin only after required payments, approvals, documents, site readiness, and prerequisites have been completed.

Schedules may be affected by supplier lead times, weather, holidays, site conditions, access restrictions, logistics, force majeure events, client approvals, or change orders. Delivery may be limited to Metro Manila and selected provinces.

BALAI conducts quality checks and punch listing before turnover. Any concern about defects, damage, or incomplete work should be reported promptly through BALAI's official contact channels.

BALAI may request photos, videos, written descriptions, site access, or an inspection meeting to assess the reported issue. After evaluation, BALAI may repair, replace, reject, or otherwise address the concern at its reasonable discretion.

BALAI provides a twenty-four (24) month structural warranty and a twelve (12) month warranty on finishes, unless a different warranty period is stated in the signed contract or written project documents.

The warranty does not cover normal wear and tear, misuse, negligence, lack of maintenance, unauthorized repairs or alterations, third-party damage, pest damage, extreme weather, flooding, fire, ground movement, acts of nature, or site conditions beyond BALAI's control.

BALAI collects and uses client information to process inquiries, quotations, orders, payments, delivery, installation, service requests, warranty claims, and customer support. Information may include the client's name, address, phone number, email address, billing details, project location, and relevant transaction information.

BALAI will use reasonable measures to keep personal information accurate, secure, and protected in accordance with applicable Philippine data privacy laws.

Designs, drawings, plans, layouts, renders, technical documents, photos, project concepts, website content, and other materials prepared or provided by BALAI remain the property of BALAI or its licensors unless otherwise agreed in writing.

To the fullest extent permitted by law, BALAI shall not be liable for indirect, incidental, special, punitive, or consequential losses arising from delays, use of products or services, or events outside BALAI's reasonable control. BALAI's total liability shall be limited to the amount actually paid for the specific product or service giving rise to the claim, unless a higher amount is required by law.

These Terms & Conditions shall be governed by and interpreted in accordance with the laws of the Republic of the Philippines. Any dispute arising from BALAI products, projects, services, or these terms shall be resolved exclusively by the proper courts of the Philippines.
